Terms of Use
Welcome to SodScope. By accessing or using our website, calculators, reports, and related services (the “Services”), you agree to these Terms. If you do not agree, do not use the Services.
Acceptance of Terms
By creating an account, purchasing a report, or otherwise using the Services, you confirm that you have read, understood, and agree to be bound by these Terms.
1) Eligibility & Accounts
- You must be at least 13 years old (or the age of digital consent in your region).
- If you are under 18, you must have permission from a parent or legal guardian.
- Keep your account credentials secure and promptly notify us of any unauthorized use.
2) License & Ownership
We grant you a limited, non-exclusive, non-transferable license to use the Services for your personal use or internal business planning and evaluation. Resale, redistribution, or commercial exploitation of outputs (beyond internal use for your own projects or clients you directly serve) is not permitted without our written consent. All intellectual property in the Services and content (other than your own uploads) remains with SodScope or its licensors.
3) AI-Assisted Outputs & Important Disclaimers
Our recommendations and reports may include AI-generated text and calculations. AI outputs can be inaccurate, incomplete, outdated, or not reflect local ordinances, utility rules, HOA requirements, water restrictions, or site-specific conditions. You must verify all recommendations on-site and with local authorities and professionals.
- No professional advice: the Services are not engineering, agronomic, legal, or financial advice.
- No guarantee of accuracy, suitability, or compliance.
- Use at your own risk; plan installations with qualified contractors.
4) User Content & Prohibited Uses
- Do not upload unlawful, infringing, or harmful content.
- Do not attempt to bypass security, scrape in violation of robots rules, or overload the Services.
- You represent you have rights to the content you submit and grant us a limited license to process, store, reproduce, and display it as needed to provide and improve the Services.
5) Payments & Refunds
Paid analyses and digital deliverables begin processing upon purchase. Fees are typically non-refundable after processing has started. If we clearly miss a major local factor, contact support and we may, at our discretion, re-issue or adjust your report.
6) Third-Party Services
We integrate with third parties such as Stripe (payments), Google Maps (mapping/geocoding), Cloudflare Turnstile (bot protection), Resend (email), Upstash (rate limiting/Redis), and PostHog (analytics). Your use of those services is also subject to each provider’s terms.
7) Service Availability
We aim for reliable service but do not guarantee uninterrupted or error-free operation. Access may be suspended or limited during maintenance, upgrades, or for reasons beyond our control.
8) Changes, Suspension, Termination
We may modify or discontinue the Services at any time. We may suspend or terminate access for conduct that violates these Terms or harms the Services or other users.
9) Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES (EXPRESS OR IMPLIED), INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI OUTPUTS OR MAP DATA.
10) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SODSCOPE AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR LOST PROFITS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE SERVICE AT ISSUE IN THE 6 MONTHS BEFORE THE CLAIM AROSE, OR (B) $100.
11) Indemnification
You agree to defend, indemnify, and hold harmless SodScope from claims arising out of your use of the Services or violation of these Terms.
12) Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Texas, United States, without regard to conflicts of laws. Before filing a formal claim, you agree to attempt informal resolution with us by emailing support@sodscope.com.
Where permitted by law, disputes will be resolved by binding arbitration on an individual basis, and you waive participation in class or representative actions. Either party may bring an individual claim in small-claims court. If arbitration is not enforceable in your location, exclusive venue lies in the state or federal courts located in Texas.
13) Force Majeure
We are not responsible for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, power or internet outages, labor disputes, acts of government, or other force majeure events.
14) Severability & Entire Agreement
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and SodScope regarding the Services.
15) Changes to Terms
We may update these Terms from time to time. Material changes will be posted to this page with an updated “Last updated” date. Continued use of the Services after changes constitutes acceptance.
